These Terms of Service ("Terms") govern your use of Cleared for Offer ("the Service"), operated by Cleared for Offer ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use. We are not liable for losses resulting from unauthorized access to your account caused by your failure to safeguard your credentials.

3. Acceptable Use

You agree not to:

• Use the Service to generate fraudulent, misleading, or deceptive application materials
• Misrepresent qualifications, credentials, or work history in generated documents
• Share your account with others or resell access to the Service
• Attempt to reverse-engineer, scrape, or extract the AI prompts or algorithms used by the Service
• Use automated tools to access the Service beyond what we provide (e.g., the CSV bulk import feature)
• Upload malicious content, malware, or content that violates applicable law

4. Service Description

The Service uses AI to generate tailored resumes, cover letters, and application emails based on content you provide. All generated materials are drafts for your review and editing. You are solely responsible for verifying the accuracy and truthfulness of any documents before submitting them to employers.

5. AI-Generated Content

Content generated by the Service is produced by artificial intelligence and may contain errors, omissions, or inaccuracies. We do not guarantee that generated content will result in job interviews or employment. You retain full ownership of your input data and the generated output.

6. Subscription Plans and Billing

Free Tier: Includes 3 applications per month at no cost, with no credit card required.

Paid Plans: Paid subscriptions are billed monthly. You may cancel at any time from your Account page. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial months.

Credit Packs: Purchased credits never expire and are non-refundable once used. Unused credits remain in your account indefinitely.

Free Trials: If a free trial is offered, you will not be charged until the trial period ends. You may cancel before the trial ends to avoid charges.

7. Refund Policy

If you are unsatisfied with a paid subscription, contact us within 7 days of your initial purchase for a full refund. After the first 7 days, refunds are issued at our discretion. Credit pack purchases are non-refundable once any credits have been used.

8. Intellectual Property

You retain ownership of all content you provide (resumes, work history, etc.) and all content generated for you by the Service. We retain ownership of the Service itself, including its design, code, prompts, and algorithms. You grant us a limited license to process your content solely for the purpose of providing the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any loss resulting from service downtime.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, or failure to obtain employment. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Florida.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice within the Service. Continued use after changes constitutes acceptance of the updated Terms.
